Terms of use

These terms apply to everyone who uses this site. By using it you accept them, and by submitting the case review form you accept them again. If you do not accept them, do not use the site.

What this service is

Compensation Guardians is an advertising and marketing service. We run campaigns inviting people who may have a workers compensation claim to describe what happened to them, and we pass those descriptions to independent attorneys and law firms who pay us to advertise with us.

What this service is not

We are not a law firm. We do not practice law, we do not give legal advice, and nobody here is your attorney. Nothing on this site is legal advice and nothing on it should be relied on as a substitute for advice from an attorney licensed in your state.

We are not a lawyer referral service. We do not evaluate, endorse, recommend or certify any attorney, and we make no representation about any attorney’s qualifications, experience or the quality of their work. Attorneys appear in our network because they advertise with us, not because we assessed them. You are responsible for satisfying yourself about any attorney before you engage them, including by checking their standing with your state bar.

We are not a doctor, an insurer or a state agency. We do not assess injuries, we do not decide claims, we cannot file anything on your behalf, and submitting this form is not a report of your injury to your employer, to an insurance carrier, or to any workers compensation board or industrial commission. Those are separate steps that only you or your attorney can take, and some of them have deadlines measured in days.

Submitting the form does not create an attorney client relationship with us or with any attorney. That relationship only begins when you and an attorney sign a written engagement agreement. Until then, what you send us is not protected by attorney client privilege.

What happens to your submission

We review it and, where it matches, pass it to one or more independent attorneys or law firms licensed in the state you were hurt in. They pay us for that. The payment buys advertising, not a recommendation, and what it means for your rights under state privacy law is set out in the privacy policy.

We do not promise that any attorney will contact you or take your case, and we do not promise any particular timescale. Attorneys decline matters for many reasons, including deadlines, the state the claim arises in, and their own caseload. If nobody takes it on, that is not an assessment of whether you have a claim, and you remain free to approach any attorney yourself or to deal with your state’s workers compensation agency directly.

Consent to be contacted

The form asks you to agree that we and one or more attorneys may contact you at the phone number and email address you give, including by automated calls and text messages. That consent is not a condition of any purchase and not a condition of legal representation. Message and data rates may apply. You can withdraw it at any time: see the do not call policy for how.

Accuracy, and what we ask of you

Submit your own details, not somebody else’s, and keep them accurate. If you are submitting on behalf of an injured family member, or of someone who died at work, say so on the call. Do not use the form to send us threats, abuse, malware, or anything you do not have the right to send. Do not scrape, probe or attempt to gain unauthorized access to any part of the site. We may refuse or delete any submission at our discretion.

Deadlines

Workers compensation runs on two clocks at once and both of them are shorter than people expect. There is a duty to report the injury to your employer, which in many states is counted in days rather than months. There is then a separate limitation period for filing the claim itself, commonly one or two years, sometimes running from the last payment of benefits rather than from the accident. A denial starts a third clock, for the appeal. Using this site does not stop, pause or extend any of them. Only reporting the injury and filing the right claim in the right forum does that. If your deadline is close, report the injury to your employer in writing today and contact an attorney or your state agency directly rather than waiting for a call.

Content on this site, and the limits of our liability

The lists and explanations here are general information about how workers compensation tends to work. Workers compensation is state law and differs substantially from state to state, so the general position described on this site may not be the position where you were hurt, and the law changes. Nothing here is tailored to your situation. Past results described by any attorney do not predict the outcome of any other matter, and no benefit amount or recovery is promised anywhere on this site.

The site is provided as is and as available. To the fullest extent the law allows, we exclude all warranties, and we are not liable for any indirect or consequential loss, for lost opportunity, for a missed deadline, or for anything done or not done by an attorney you are connected with. Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

Changes, governing law and contact

We may update these terms. The version that applies to your submission is the one published when you made it, and the date below is kept current.

These terms are governed by French law, which is where the publishing company is established. If you are a consumer this does not deprive you of the protection of the mandatory rules of the country you live in, and you may bring proceedings in your own courts.
